CRITICAL REMARKS CONCERNING THE DEFINITION OF NOISE LIMITS FOR ROAD TRAFFIC

KRITISCHE ANMERKUNGEN ZUR FESTLEGUNG VON LAERMGRENZWERTEN FUER DEN STRASSENVERKEHR

The opinions expressed deal with the draft of legislation for the protection against traffic noise in the vicinity of road and rail routes, which is intended to provide the basis for considerably higher limits than would be necessary according to the federal noise pollution law. This legislation is also intended to circumvent the basic ruling of the federal administrative court which considers continuous noise levels of 45 db(a) at night and 55 db(a) during the day as the highest that should be permitted in residential areas. The submission demands among other things the regulation of noise protection along existing roads in new legislation. Strong criticism is expressed of the noise levels for new or improved roads through residential areas of 65 db(a) during the day and 55 db(a) at night. Demands are made for more progressive differentiation in accordance with the need for noise protection on the basis of land use and also for lower absolute noise limits. On the basis of the limits demanded, so it can be estimated that a maximum of 20% of the investment costs are required for noise protection. These costs are clearly consequential and avoidance costs which the highway authorities must bear in accordance with the causal principle. If the proposed legislation were to come into force, the prescribed noise limits would mean that about 40% of the population would be subject to strong and 60 to 70% to medium to strong noise pollution. /TRRL/
