THE NEED FOR REFORM IN THE USE OF DRIVING LICENCE CONFISCATION AND DRIVING PROHIBITIONS

REFORMBEDUERFTIGKEIT VON FAHRERLAUBNISENTZUG UND FAHRVERBOT?

The prevailing legal position is described, and a critique is made in the light of the principle of "inappropriateness" and its application. Under specific circumstances it is recommended that probation be substituted for confiscation of driving licenses. It is suggested that punitive prohibition of driving should be extended from three months to five years, that probation be substituted for driving prohibition, and that confiscation of driving licenses be reserved exclusively to the administrative authorities, except in cases of temporary incapability of guilt. The judge should have the option of immediately confiscating a driving license and at the same time requesting the administrative authority to have the driver submitted to a psychological examination. Driver re-training is advocated. /TRRL/
