THE NECESSITY FOR REFORM WITH RESPECT TO WITHDRAWALS OF DRIVING LICENCES AND DRIVING BANS

REFORMEDUERFTIGKEIT VON FAHRERLAUBNISENTZUG UND FAHRVERBOT?

It is recommended that for drivers committing traffic offences the trend in penalties should be away from measures of a repressive nature and towards penalties which may be expected to have a lasting educational effect. Among these can be included traffic education and intensive supplementary driving training of the offenders. In the case of drivers convicted of driving without a licence instead of imposing a driving ban they should be given the opportunity of obtaining a driving licence in a legitimate manner. It is further suggested, that driving bans should be capable of being suspended for probationary periods, to limit driving bans to particular localities and to limit driving bans to offences directly connected with the use of motor vehicles by the offenders. It is also suggested that the licensing authority be bound by the judicial decisions when assessing the suitability of applicants. /TRRL/
