PROBLEMS OF FEDERAL PARTICIPATION IN THE JUDICIAL AWARD OF LANDOWNER'S COURT COSTS

THE BPR REFUSES TO PARTICIPATE IN CERTAIN RIGHT-OF-WAY COURT COSTS WHICH THE STATES ARE COMPELLED TO PAY UNDER JUDGEMENT OF THE COURTS. IT IS POSTULATED THAT CONGRESS NEVER INTENDED THAT THE BPR MIGHT CHOOSE AMONG THE MANY TYPES OF ITEMS INVOLVED IN THE COST OF HIGHWAY CONSTRUCTION, ESPECIALLY RIGHT-OF-WAY COSTS, AND DECIDE TO PARTICIPATE IN SOME AND NOT IN OTHERS. THE HISTORY AND LEGALITY OF THE RULE IS INVESTIGATED.
