SUMMARY OF 1970 REPORT OF COMMITTEE ON CONDEMNATION AND CONDEMNATION PROCEDURE, SECTION OF LOCAL GOVERNMENT LAW, AMERICAN BAR ASSOCIATION

THIS CIRCULAR DEALS WITH CONDEMANTION PROCEDURES AND THE CURRENT STATUS OF JOINT DEVELOPMENT AND MULTIPLE USE. UNDER THE FIRST TOPIC, A BRIEF REVIEW IS MADE OF THE 1970 REPORT OF THE COMMITTEE ON CONDEMATION AND CONDEMNATION PROCEDURE OF THE AMERICAN BAR ASSOCIATION. PART I OF THE REPORT COVERS 644 APPELLATE COURT CASES ON CONDEMNATION OF PROPERTY FOR PUBLIC PURPOSES. PART II ANALYZES SAMPLE CONDEMNATION CLAUSES FOR SHORT- AND LONG- TERM LEASES. PART III AND IV ARE THE TEXTS OF THE NATIONAL ENVIRONMENTAL POLICY ACT OF 1969 AND THE ENVIRONMENTAL QUALITY IMPROVEMENT ACT OF 1970. PART V IS A PAPER ON HOW TO "JAZZ UP" A CONDEMNATION TRIAL. UNDER THE SECOND TOPIC THREE FHWA DOCUMENTS ARE SUMMARIZED. (1) "HIGHWAY JOINT DEVELOPMENT AND MULTIPLE USE" IS A FEBRUARY 1970 UPDATE OF THE 1968 REPORT IDENTIFYING SUCH PROJECTS AND DESCRIBING THE BENEFITS ACQUIRING FROM RELATED POLICIES. (2) INTERIM POLICY AND PROCEDURE MEMORANDUM 21-19 20-01 OF 17 JANUARY 1969 DEALS WITH THE PROCEDURES TO BE FOLLOWED IN JOINT DEVELOPMENT PLANNING ACTIVITIES RELATED TO NEW FACILITIES ON FEDERAL-AID SYSTEMS WITHIN URBANIZED AREAS AND WITH POLICIES FOR FEDERAL PARTICIPATION IN THE COSTS OF SUCH PLANNING AND OF THE IMPLEMENTATION OF THE RESULTING JOINT DEVELOPMENT PLAN. (3) INSTRUCTIONAL MEMORANDUM 21-2-69 34-50 OF THE SAME DATE HAS THE TITEL "FEDERAL PARTICIPATION IN THE DEVELOPMENT OF MULTIPLE USE FACILITIES ON THE HIGHWAY RIGHT-OF-WAY" AND DESCRIBES THE PROCEDURAL REQUIREMENTS FOR PLANNING MULTIPLE USE PROJECTS.
