LAW, TRAFFIC AND ENGINEERING TECHNOLOGY

DATA ARE REVIEWED ON HIGHWAY TRAFFIC FATALITY. MEANS OF AVOIDING HIGH ENERGY IMPACT ARE DESCRIBED AND DISCUSSED WITH EXAMPLES PRESENTED FROM EXPERIENCE AT THE GENERAL MOTORS PROVING GROUND. A BRIEF HISTORY IS PRESENTED OF THE DEVELOPMENT OF THE EXISTING NETWORK OF ROADS AND STREETS. PROGRESS IS BEING MADE IN ATTEMPTING TO DEFINE THE PROPER PATH AND ACTION AND CONDUCT OF EVERY DRIVER ALONG EVERY FOOT OF THE ROAD EVERY MINUTE. DRIVERS WHO FOLLOW THESE DEFINITIONS, OR REGULATIONS, SHOULD NEVER BE INVOLVED IN AN ACCIDENT. ACCIDENT REDUCTIONS CAN BE MADE BY RECOGNIZING THAT THE HIGHWAY NETWORK DOES NOT LEAVE ENOUGH ROOM FOR THE OCCASIONAL UNREALIABILITY OF DRIVERS. THE SOLUTION IS TO REMOVE THE OBSTACLES, TREES AND ROCKS AND SHARP DITCHES AND OPPOSING TRAFFIC. APPLICATION OF ENGINEERING TECHNOLOGY WILL REDUCE THE NUMBER AND COST AND SEVERITY OF ACCIDENTS. THE LEGAL ASPECT OF ENGINEERING IMPROVEMENTS ARE COMMENTED UPON BY MR. CHESHIRE. NEEDS FOR STUDY ARE RECOMMENDED IN THE FOLLOWING AREAS OF LEGAL RESEARCH: (1) QUESTIONS RAISED BY THE USE OF CONDEMNATION AND PURCHASE TO ACQUIRE THE LAND, EASEMENTS, OR OTHER INTERESTS IN REAL PROPERTY WHICH WOULD BE INVOLVED IN UNDER-TAKING A PROGRAM OF CLEARING ROADWAYS, ROADSIDES, AND ADJACENT AREAS OF ALL OBSTACLES CONTRIBUTING TO THE SEVERITY OF VEHICLE-FIXED OBJECT COLLISIONS, (2) QUESTIONS BEARING ON MANUFACTURERS' LEGAL LIABILITY FOR DEFECTIVE DESIGN OF VEHICLES, (3) IDENTIFICATION OF SOME OF THE SPECIFIC AREAS WHERE THE ENGINEERS FEEL THERE ARE LIMITATIONS ON THEIR TECHNOLOGICAL EFFORTS BECAUSE OF THE LAW, AND (4) ENGINEERING DESIGN FOR SPEED, SIZES AND WEIGHTS, AND ELECTRONIC CONTROLS OF BOTH THE VEHICLE AND THE HIGHWAY. THE PROVISIONS OF THE UNIFORM VEHICLE CODE ARE DISCUSSED BY DR. MONTGOMERY. VEHICULAR DESIGN IS DISCUSSED BY MR . FREED. MR. GOLDSTEIN DISCUSSES DRIVER PSYCHOLOGY AND SPEED LIMITS. MR. SAAL DISCUSSES THE STANDARDS FOR MOTOR VEHICLE INSPECTION IN CONNECTION WITH THE UNIFORM VEHICLE CODE. MR. SORNSON DISCUSSES ACCIDENT RESEARCH IN REGARD TO ACCIDENT CAUSES, VEHICULAR DESIGN AND INTERSTATE COMPACTS.
