CHANGE OF GRADE

THE CASE LAW ON CHANGE OF GRADE IS RATHER BULKY. HOWEVER, THE REPORTED CASES CONSTITUTE A HIGHLY SUPERFICIAL TREATMENT OF A DIFFICULT PROBLEM. IT IS THE AUTHOR'S BELIEF THAT IF THE APPRAISER-ATTORNEY TEAM WILL EVALUATE THE PROBLEM OF CHANGE OF GRADE IN LIGHT OF WHAT HE HAS WRITTEN, THE ULTIMATE RESULT MIGHT PROVE MORE SATISFACTORY TO THE HIGHWAY AGENCY THAN OTHERWISE. HE CONCLUDES THAT WHILE A CHANGE OF GRADE MIGHT BE COMPENSABLE WHERE IMPROVED PROPERTY IS INVOLVED, THE SAME CHANGE OF GRADE MIGHT NOT BE COMPENSABLE WHERE UNIMPROVED PROPERTY IS INVOLVED. /AUTHOR/
