DUAL MODE TRANSPORTATION: EMERGING LEGAL AND ADMINISTRATIVE ISSUES

THIS ARTICLE IS A PRELIMINARY ANALYSIS OF ADMINISTRATIVE, LEGAL AND SOCIAL POLICY ISSUES RAISED BY PROPOSED DUAL MODE TRANSPORTATION SYSTEMS. THE NECESSARY DEGREE OF CENTRALIZED CONTROL OVER SYSTEM DESIGN, CONSTRUCTION OR OPERATION IS DISCUSSED. ALTERNATIVE ACCIDENT LIABILITY AND COMPENSATION SCHEMES ARE EVALUATED; THE DISCUSSION INDICATES THAT ACCIDENT COSTS SHOULD BE DISTRIBUTED TO THE SYSTEM OPERATOR OR TO THE GUIDEWAY OPERATOR THROUGH AN ENTERPRISE LIABILITY PLAN. TO AVOID THE ACCUSATION THAT DUAL MODE TRANSPORTATION WOULD BE SEPARATE AND UNEQUAL TRANSPORTATION PLANNERS SHOULD DEVISE A COMPREHENSIVE DUAL MODE FINANCING AND FARE POLICY.
