LEGAL REQUIREMENTS OF LOCATION PLANNING

IN THIS REPORT IT IS URGED THAT A SYSTEMATIC AND REALISTIC EFFORT TO COMPLY WITH ALL THE FEDERAL REQUIREMENTS BE MADE IN PLANNING HIGHWATS. THIS SHOULD BE DONE AT THE VERY FIRST STAGE OF PLANNING ITS LOCATION. THE MAJORITY OF THE REPORT DEALS WITH COURT CASES INVOLVING ENVIRONMENTAL LAWSUITS. THE REPORT CONCLUDES THAT IT IS APPARENT THAT THE COURTS WILL REQUIRE STRICT COMPLIANCE WITH THE FEDERAL LAWS AND REGULATIONS IN PLANNING AND CONSTRUCTING HIGHWAYS, AND ASLO THAT THE COURTS ARE TENDING TO APPLY THE ENVIRONMENTAL LAWS RETROACTIVELY, ESPECIALLY IF THEY CAN FIND SOME FURTHER REQUIRED ON THE PART OF A STATE HIGHWAY DEPARTMENT OR THE FEDERAL HIGHWAY ADMINISTRATION.
