ENFORCEMENT PROBLEMS IN THE AIR QUALITY FIELD: SOME INTERGOVERNMENTAL STRUCTURAL ASPECTS

THE STATE AND LOCAL INTERGOVERNMENTAL PROBLEMS CREATED BY THE NEED TO ENFORCE AIR POLLUTION CONTROL LAWS AND REGULATIONS ARE CONSIDERED. AN AIR QUALITY CONTROL REGION BASED SPECIAL DISTRICT IS PROPOSED. THE AIR QUALITY CONTROL REGIONS DISIGNATED PURSUANT TO THE 1967 AND 1970 FEDERAL ACTS, BASED ON POPULATION, TOPOGRAPHICAL AND METEOROLOGICAL FACTORS, AND ON EXISTING POLITICAL ARRANGEMENTS, WOULD SEEM TO BE THE LOGICAL GEOGRAPHICAL BASE UPON WHICH TO SUPERIMPOSE A SPECIAL DISTRICT. THIS DEVICE OFFERS THE MOST HOPE OF TRANSCENDING POLITICAL BOUNDARIES AND ACHIEVING EFFECTIVE CONTROL IN A METROPOLITAN AREA.
