SYMPOSIUM ON NO-FAULT AUTOMOBILE INSURANCE: PERSPECTIVES ON THE PROBLEMS AND THE PLANS

A COMPREHENSIVE PICTURE OF THE PROBLEMS RELATED TO NO- FAULT, THEIR PROPOSED SOLUTIONS AND THE EXPERIENCE THAT CERTAIN JURISDICTIONS HAVE HAD WITH ATTEMPTED SOLUTIONS ARE PRESENTED. THE AUTHORS AGREE THAT THE BASIC CONCEPT OF NO- FAULT INSURANCE WILL BE IMPLEMENTED IN ONE FORM OR ANOTHER. THE PROBLEMS OF THE TORT-INSURANCE SYSTEM PRESENTLY IN USE ARE DETAILED. FOUR ARTICLES FOCUS ON THE VARIOUS PLANS THAT HAVE BEEN OFFERED TO IMPLEMENT NO-FAULT ON THE STATE LEVEL. THERE IS A CRITIQUE OF SOME OF THE EXISTING NO-FAULT STATUTES IN CANADA AND THE U. S. THE CONSTITUTIONALITY OF NATIONAL NO-FAULT, AND THE ACTUAL COST TO THE PUBLIC OF A NO-FAULT SYSTEM ARE DISCUSSED. /AUTHOR/
