AN ATTORNEY GENERAL LOOKS AT THE HIGHWAY CONDEMNATION LAW

FOUR PROBLEMS RELATING TO CONDEMNATION PROCEDURES ARE DISCUSSED: (1) UPDATING OF CONDEMANTION PROCEDURES, PERHAPS THROUGH PERIODIC REVISION OF EMINENT DOMAIN STATUTES, PARTICULARLY WITH THE AIM OF EXPEDITING CASES; (2) OVERCOMING THE TREND TOWARD HIGH VERDICTS, PERHAPS THROUGH HAVING JURIES MAKE AWARDS ONLY AFTER HIGHWAY COMPLETION AND THROUGH AVOIDANCE OF APPEALS JOINED WITH ALLEGATIONS OF ERROR (WHICH HAVE THE EFFECT OF BECOMING LAW IN EVENT OF ADVERSE DECISIONS); (3) RELATIONSHIPS WITH FEDERAL AUTHORITY; AND (4) EXCHANGE OF CONDEMNATION BRIEFS AMONG STATE HIGHWAY OFFICIALS AND ATTORNEYS.
