The Regulation of Registered Traveler Programs

The purpose of this article is threefold: first, it will show that different motivations - commercial - or government-driven - for the establishment of a Registered Traveler Program lead to different outcomes in the setting-up of these programs; second, that a major factor in a Registered Traveler Program is a State's attitude towards privacy rights and data protection; and third, that the legal status of a Registered Traveler Program's smart card or token is not always clear, that it should be clarified and that ICAO would be the best party to undertake this. The foregoing will be demonstrated and argued by analysis of the relevant legal framework, as well as by comparing the existing Registered Traveler Programs in the Netherlands and the United States, and the proposal for a regulation establishing a Registered Traveler Program in the European Union.
