LEGAL REQUIREMENTS OF LOCATION PLANNING

ISSUES, CASES, AND DECISIONS WHICH HAVE ARISEN FROM INFRACTIONS OF THE NATIONAL ENVIRONMENTAL POLICY ACT, THE UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES ACT, AND THE FEDERAL AID HIGHWAY ACT (TITLE 23, SECS 501, ET SEQ.) ARE DISCUSSED. THE COURTS HAVE BEEN DEMANDING STRICT COMPLIANCE WITH THE FEDERAL LAWS AND REGULATIONS IN THE PLANNING AND CONSTRUCTION OF HIGHWAYS TO THE EXTENT THAT THE ENVIRONMENTAL LAWS ARE BEING APPLIED RETROACTIVELY TO HIGHWAY PROJECTS.
