THE PROBLEM DRINKING DRIVER - A LEGAL PERSPECTIVE

LEGAL ASPECTS OF DRIVING WHILE INTOXICATED ARE EXPLORED. THE STATUTORY, COMMON, AND ADMINISTRATIVE LAW AFFECTING THE RELATIONSHIP BETWEN THE "DRUNK DRIVER" AND THE TRAFFIC LAW SYSTEM ARE INVESTIGATED. THE STUDY PROCEEDS ON THE BASIS OF THREE INTERRELATED STRUCTURES THAT CONSTITUTE AN ANALYTIC FRAMEWORK: THE CHRONOLOGICAL ORDER OF EVENTS AS THE DRIVER INTERACTS WITH THE TRAFFIC LAW SYSTEM, CHOICE OF ISSUES WITHIN THIS FRAMEWORK ACCORDING TO THE NEEDS OF THOSE INVOLVED IN THE IMPLEMENTATION OF COUNTERMEASURES PROGRAMS, AND THE TEST OF RELEVANCY AS EMPLOYED IN THE DEVELOPMENT OF A LEGAL MEMORANDUM.
