Recovery and Removal of Wrecks and Sunken Objects – Modern Solutions Finally Implemented in the Croatian Maritime Code

Since Maritime Code Amendments from 2004, provisions which were valid for the salvage were also applicable to the recovery of sunken objects. Such a solution was reasonably criticized. In 2007, the International Convention on the Removal of Wrecks was adopted, but it has not yet entered into force. Amendments to the Maritime Code from 2013 regulate recovery and removal of wrecks and sunken objects separately and apart from the institute of salvage. The provisions on the wrecks and sunken objects removal were created in accordance with the already mentioned International Convention on the Removal of Wrecks. This paper analyzes the solutions of the positive Croatian Maritime Code on recovery and removal of wrecks and sunken objects, liability for damages that can occur during such activities and other relevant provisions of this institute. Amendments to the Maritime Code were necessary, and they provide a comprehensive and modern solution. Besides increasing legal certainty they should also increase the maritime safety and reduce pollution of the marine environment.
