RELOCATION THROWS A NEW CURVE IN HIGHWAY ENVIRONMENTAL SUITS

RECENT LAW SUITS CHALLENGE PROCEDURES FOR CONDUCTING ENVIRONMENTAL STUDIES AND IMPLEMENTING RELOCATION PROGRAMS ON HIGHWAY JOBS. CHALLENGERS CONTEND THAT BOTH ENVIRONMENTAL AND RELOCATION LEGISLATION APPLY IMMEDIATELY, EVEN TO PROJECTS ALREADY UNDER CONSTRUCTION. AS A RESULT, STATE AND FEDERAL OFFICIALS WERE ORDERED IN SAN FRANCISCO TO COMPLY WITH THE NATIONAL ENVIRONMENTAL PROTECTION ACT (SIGNED JANUARY 1, 1970) AND THE UNIFORM RELOCATION ACT (1970) AND SUSPEND WORK ON AN INTERSTATE HIGHWAY SECTION (I-90), EVEN THOUGH THE LOCATION WAS APPROVED PRIOR TO PASSAGE OF THOSE MEASURES.
