SUMMARY OF SENATE REPORT ON S. 1 (MUSKIE BILL), 1969

S. 1, THE UNIFORM RELOCATION ASSISTANCE AND LAND ACQUISITION POLICIES ACT OF 1969, IS DESIGNED TO PROVIDE FOR UNIFORM AND EQUITABLE LAND ACQUISITION POLICIES FOR FEDERAL AND FEDERALLY ASSISTED PROGRAMS. S. 1 FOLLOWS THE SUBSTANTIVE PROVISIONS OF HOUSING AND URBAN DEVELOPMENT ACT AND THE FEDERAL HIGHWAY ACT, GIVING ATTENTION TO THE NEED FOR CONSISTENCY IN DEALINGS WITH PROPERTY OWNERS AND DISPLACED PERSONS. IT PLACES RESPONSIBILITY FOR COORDINATION OF ALL FEDERAL OPERATIONS UNDER THE ACT IN THE EXECUTIVE OFFICE OF THE PRESIDENT. THE BILL PROVIDES THAT ONE STATE OR LOCAL AGENCY MAY MAKE RELOCATION PAYMENTS AND PROVIDES RELOCATION ASSISTANCE ON BEHALF OF ALL PROGRAMS CAUSING DISPLACEMENT IN THE LOCALITY. AMENDMENTS TO THE ACT PROVIDE FOR: THE COMPARABILITY OF ASSISTANCE PROVISIONS BETWEEN FARM AND BUSINESS OPERATIONS; PROVISIONS TO COVER SMALL BUSINESS DISPLACEMENT; FLEXIBLE REIMBURSEMENT PROVISIONS TO FIT THE ECONOMIC CHARACTERISTICS OF DIFFERENT PARTS OF THE COUNTRY, IN ORDER TO TAKE INTO ACCOUNT EXTRAORDINARY HIGH COST-OF- LIVING AREAS; THE ADDITION OF SECTION 233 WHICH WOULD MAKE ELIGIBLE FOR RELOCATION RELIEF, RESIDENTS OR BUSINESSES REMAINING ON, OR MOVE TO, PROPERTY AFTER IT WAS ACQUIRED BY A FEDERAL AGENCY, PROVIDING THEY REMAINED ON THE PROPERTY AT LEAST ONE YEAR PRIOR TO THE DATE OF ENACTMENT OF THE LEGISLATION. JUDICIAL REVIEW PROVISIONS ARE OUTLINED. S. 1 PASSED THE SENATE ON OCTOBER 27, 1969. HEARINGS WERE HELD BY THE HOUSE AND ADDITIONAL HEARINGS ARE SCHEDULED FOR JANUARY 1970 WHEN CONGRESS RECONVENES.
