A COMPARISON OF STATUTORY AND COURT-MADE RULES OF EMINENT DOMAIN VALUATION WITH ACTUAL PRACTICES

OBSERVATIONS ARE MADE ON THE RELATIONSHIP BETWEEN THE LAW OF EMINENT DOMAIN VALUATION AS IT EXISTS ON THE BOOKS AND THE ACTIVITIES OF HIGHWAY ADMINISTRATORS WORKING UNDER THE LAW. THIS WISCONSIN STUDY SHOWS THE PRESENT INABILITY TO OFFSET BENEFITS AGAINST DAMAGES SUFFERED BY THE PROPERTY. THE EFFECT OF THE INABILITY TO OFFSET BENEFITS IS TO INCREASE THE COSTS OF RIGHT-OF-WAY ACQUISITION. THE IMPORTANCE IS DISCUSSED OF THE REAL ESTATE APPRAISER IN HIGHWAY LAND ACQUISITION. PROBLEMS ARE DISCUSSED OF THE ADMINISTRATIVE AWARD SYSTEM AND OF ECONOMICS AS A LIMIT ON JUST COMPENSATION.
