THE ELASTIC RIGHT - ACCESS

THE VALUATION OF ACCESS RIGHTS IN CONDEMNATION CASES IS DISCUSSED, POINTING OUT THAT MOST COURTS HAVE ADOPTED THE RULE THAT THE PROPERTY OWNER IS NOT ENTITLED TO ACCESS AT ALL POINTS ALONG THE BOUNDARY, BUT ONLY TO REASONABLE ACCESS. SINCE REASONABLE MEN MAY DIFFER UPON WHAT IS REASONABLE, THE STATEMENT THAT THE RIGHT TO ACCESS IS A MOST ELASTIC RIGHT SEEMS FULLY JUSTIFIED. THE ARTICLE SUGGESTS A SOLUTION TO THIS PROBLEM, AND DISCUSSES OTHER PROBLEMS OF ACCESS. /AUTHOR/
