PHOTOGRAMMETRY AND HIGHWAY LAW

SOME OF THE RAMIFICATIONS ARE PRESENTED OF THE USE OF PHOTOGRAMMETRY IN LEGAL AND QUASI-LEGAL PROCEEDINGS, IN ADMINISTRATIVE DETERMINATIONS OF A LEGAL NATURE, AND TO INDICATE TRENDS IN THE STATUTORY AND CASE LAW ILLUSTRATING RECOGNITION OF THE RELIABILITY OF PHOTOGRAMMETRICALLY MADE MEASUREMENTS IN THE COURT AND ELSEWHERE. THE SCIENCE OF AERIAL PHOTOGRAPHY HAS BEEN DEVELOPED IN THE LAST 25 YEARS, AND THIS DEVELOPMENT IS REVIEWED. WITH RESPECT TO ADMISSIBILITY AS EVIDENCE, THE PRODUCTS OF PHOTOGRAMMETRY ARE TREATED ALMOST UNIVERSALLY BY THE COURTS AS ANY OTHER PHOTOGRAPH OR STEREOSCOPIC MODEL. CALIFORNIA APPEARS TO BE THE ONLY STATE WHICH DOES STATUTORILY RECOGNIZE PHOTOGRAMMETRY BUT THE QUESTION OF ADMISSIBILITY IS BASED UPON THE DISCRETION OF THE TRIAL JUDGE IN ANY GIVEN LITIGATION. IN THE FIELD OF EMINENT DOMAIN IN PARTICULAR, EVIDENCE IN THE FORM OF AERIAL PHOTOGRAPHS IS DEEMED TO HAVE GREAT POTENTIAL. IT APPEARS REASONABLE TO ASSUME THAT THE USE OF PHOTOGRAMMETRY WILL STEADILY INCREASE IN SUCH AREAS AS PLANNING, SURVEYING, DESIGNING, AND PROCURING RIGHTS-OF- WAY FOR HIGHWAY DEVELOPMENT AND THE LEGISLATURES WILL RECOGNIZE THE NEED FOR STATUTORY REVISION TO PROVIDE FOR THE ACCEPTANCE OF PHOTOGRAMMETRY AS A METRICAL SCIENCE.
