PROFIT, LAW, AND MASTER PLANNING FOR PARKS

THE LEGAL ASPECTS OF PARK MASTER PLANNING ARE THE MOST IMPORTANT DETERMINANTS OF THE SUCCESS OR FAILURE OF LONG- RANGE MASTER PLANS. IN THE ABSENCE OF CERTAIN SPECIFIC OR ADEQUATE LEGISLATION (PROTECTING PARKLANDS FROM OTHER INTRUSIONS), THE PARK PLANNER STANDS HELPLESSLY BY AS HIS PARK DEVELOPMENT PROGRAM DWINDLES TO LESS OF A REALITY, LESS OF A POSSIBILITY, AND HIS MASTER PLAN BECOMES A PAPER DREAM. IN LIGHT OF THE FACTS, LEGISLATION WHICH AFFECTS LAND DEVELOPMENT IS EXTREMELY IMPORTANT. A MASTER PLAN, TO SECURE ITS AIM OF ADEQUATE LAND FOR PARKS AND RECREATION FOR PRESENT AND FUTURE GENERATIONS, MUST INCLUDE STUDY OF, AND RECOMMENDATIONS FOR, LEGISLATION. THIS LEGISLATION SHOULD ENCOURAGE OR GUARANTEE THAT LAND WILL BE SECURED FOR PARK DEVELOPMENT WHEN IT IS NEEDED.
