OWNER-ENGINEER-CONTRACTOR RELATIONS IN TUNNELING

THE ENGINEER, THE CONTRACTOR, AND THE OWNER SHOULD REMEMBER TO STRESS THE TEAM AND/OR PARTNER CONCEPT IN WHICH EACH IS WORKING TOGETHER TO COMPLETE A PROJECT IN THE SHORTEST TIME FOR THE LOWEST COST. IN ADDITION, IT IS THE RESPONSIBILITY OF THE OWNER TO MAKE SURE HE HAS A SOUND FINANCIAL BASE FOR THE PROJECT, INCLUDING CONTINGENCY ALLOWANCES, BEFORE SOLICITING BIDS. IN ESSENCE, THE RECOMMENDED SUGGESTIONS FOR ALL PARTIES CONCERNED INVOLVE: (1) REDUCING THE NUMBER OF CLAIMS, (2) SETTLING DISPUTES PROMPTLY AT THE PROJECT OR AT THE LOWEST POSSIBLE LEVEL WHENEVER FEASIBLE, AND (3) MINIMIZING LITIGATION BY ARBITRATION OR THE USE OF INTERMEDIARIES.
