Residual Common Carrier
This paper reviews the usage and meaning of the term "residual common carrier". It is a term frequently found in the decisions of the Surface Transportation Board, but not defined or found in either the statute administered by the Board, 49 U.S.C. Subtitle IV, or its implementing regulations, 49 C.F.R. Subtitle B, Chapter X. The most obvious residual common carrier is a rail carrier that leases its line to be operated by another rail carrier. Several examples of the use of the term in this context are given.
