ROAD WORKS AND THE EFFECT OF AN INDEMNITY CLAUSE

BRIEF REFERENCE IS MADE TO LEGAL PROCEEDINGS IN WHICH A COUNTY COUNCIL WAS REQUIRED TO PAY THE COSTS INCURRED IN DEFENDING AN UNSUCCESSFUL CLAUSE BROUGHT AGAINST THEM FOR PERSONAL INJURIES ALLEGEDLY RESULTING FROM ROAD WORKS. THE COUNCIL WAS NOT RELEIVED OF LIABILITY BY AN INDEMNITY GIVEN UNDER THE INSTITUTION OF CIVIL ENGINEERS CONDITIONS OF CONTRACT. /RRL/
