SAMPLE PROVISIONS FOR A LOCAL LAW TO REGULATE SIGNS

THESE SAMPLE PROVISIONS FOR A LOCAL LAW TO REGULATE SIGNS PROVIDE A FRAMEWORK FOR LOCAL GOVERNMENT OFFICIALS TO USE IN DEVELOPING A SIGN LAW TO MEET THE REQUIREMENTS ESTABLISHED BY THE UNIQUE CONDITIONS IN THEIR OWN COMMUNITIES. THEY HAVE BEEN WRITTEN PRIMARILY FOR A COMMUNITY WITH ZONING REGULATIONS. SIGN REGULATIONS OFTEN ARE AN ELEMENT IN THE ZONING LAW. NEVERTHELESS, SOME COMMUNITIES NOT HAVING A ZONING LAW MAY WISH TO ADOPT SIGN CONTROLS. THESE PROVISIONS CAN BE MODIFIED FOR ADOPTION AS A SEPARATE LAW. THE FIRST STEP FOR ANY LOCAL GOVERNMENT WANTING TO INITIATE A SIGN CONTROL PROGRAM IS TO CONDUCT AN INVENTORY OF EXISTING SIGNS. THIS WILL PINPOINT MOST OF THE CONDITIONS WHICH SHOULD BE TAKEN INTO CONSIDERATION IN DEVELOPING A SIGN LAW AND SHOW THE WAY TO OTHER STEPS NECESSARY FOR IMPROVING THE QUALITY OF SIGNS. IT ALSO WILL PROVIDE BASIC INFORMATION FOR DETERMINATION OF CONFORMANCE OR NONCONFORMANCE AFTER A LAW IS ADOPTED. MANY MODIFICATIONS COULD BE MADE IN THESE PROVISIONS TO ADAPT THEM TO VARIOUS AND UNIQUE SITUATIONS. SOME COMMUNITIES WILL FIND IT DESIRABLE TO INCLUDE LICENSING PROVISIONS FOR THE ERECTION AND MAINTENANCE OF SIGNS BY OUTDOOR ADVERTISING COMPANIES, ALONG WITH A FEE SCHEDULE FOR THIS. BONDING AND LIABILITY INSURANCE ALSO MIGHT BE AMONG THE CONSIDERATIONS EXPRESSED IN SUCH PROVISIONS. /AUTHOR/
