THE ARBITRATION OF EMINENT DOMAIN CASES

THE POSSIBLE APPLICABILITY OF ARBITRATING EMINENT DOMAIN CASES IS DISCUSSED. ARBITRATION HAS CERTAIN INHERENT ADVANTAGES WHICH ARE LISTED AND DISCUSSED. THESE ADVANTAGES ARE: (1) TIME, (2) COSTS, (3) LIMITATION OF RIGHTS, (4) AVOIDANCE OF LOCAL PREJUDICE, (5) PRIVACY OF ARBITRATION, AND (6) PUBLIC RELATIONS. FAST, FAIR ACQUISITION OF RIGHT OF WAY, CONSISTENT WITH GOOD PUBLIC RELATIONS, ARE LEGITIMATE GOALS THAT CAN BE GAINED BY ARBITRATION. THE ARBITRATION PROCESS DESERVES GREATER CONSIDERATION, AND A GREATER ROLE IN RIGHT OF WAY ACQUISITION.
