LEGAL ADMINISTRATIVE AND FINANCIAL ASPECTS OF URBAN PARKING SURVEYS

URBAN PARKING SURVEYS MUST INVESTIGATE THE LEGAL, ADMINISTRATIVE, AND ECONOMIC PHASES OF THE PROBLEM. THE APPROACH SUGGESTED IS TO OBTAIN AN OUTLINE OF EXISTING LAWS, PRESENT ADMINISTRATIVE MACHINERY, AND EXISTING NEEDS OF FINANCING PARKING FACILITIES IN A PARTICULAR CITY. THE FOLLOWING LEGAL ASPECTS MUST BE SURVEYED: (1) STATE ENABLING LEGISLATION DEALING WITH OFF-STREET AUTOMOBILE PARKING FACILITIES, (2) STATE ENABLING LEGISLATION OF SPECIAL AND LOCAL CHARACTER DEALING WITH OFF-STREET AUTOMOBILE PARKING FACILITIES, (3) ZONING OR OTHER LOCAL ORDINANCES REGULATING LAND USE IN RELATION TO PARKING FACILITIES, (4) PUBLIC REGULATION OR LICENSING OF COMMERCIAL OFF-STREET PARKING FACILITIES, (5) GENERAL AUTHORIZATIONS, (6) CURB PARKING RESTRICTIONS AND POLICE REGULATIONS, (7) JUDICIAL DECISIONS, AND ATTORNEY GENERAL AND CITY ATTORNEY OPINIONS, (8) USE OF THE POWER OF EMINENT DOMAIN, AND (9) TAX AND OTHER PUBLIC CONCESSIONS TO PRIVATE OPERATORS. THE VARIOUS TYPES OF PARKING FACILITIES ARE DEFINED AND ANALYZED. ALL PHASES OF THE FINANCING AND ECONOMICS OF THE PROVISION OF PARKING FACILITIES ARE INVESTIGATED AND REPORTED. SEVERAL RECENT PARKING STUDIES ARE ANALYZED.
