Environmental law and road reserves

Road authorities and other statutory bodies need to be aware of responsibilities resulting from environmental legislation relating to planning, design, construction, use and maintenance activities within road reserves. This report seeks to assist road authorities to understand the broad scope and the legal nature of their environmental responsibilities. The report outlines the nature of Commonwealth and state environmental legislative schemes relating to activities which have the potential to result in adverse environmental impact in (at least) the following areas: habitat protection; vegetation clearance; land degradation; grazing and cultivation; protection of biological diversity; noxious plants and animals; pollution control; protection of watercourses; contaminated land; and heritage protection.
