LABOR RELATIONS IN PUBLIC AGENCIES: A COUNTY ORDINANCE

THE COUNTY OF SANTA CLARA ENACTED ON JANUARY 13, 1969, A NEW ORDINANCE IN WHICH SPECIFIC PROCEDURES, RIGHTS, AND RESPONSIBILITIES OF MANAGEMENT AND EMPLOYEE ORGANIZATIONS ARE DELINEATED. THE ORDINANCE CONTAINS THE FOLLOWING PROVISIONS: (1) IT IS THE POLICY OF THE COUNTY TO PROMOTE FULL COMMUNICATION BETWEEN THE COUNTY AND ITS EMPLOYEES, (2) A RECOGNIZED EMPLOYEE ORGANIZATION HAS THE RIGHT TO MEET AND CONFER IN GOOD FAITH TO NEGOTIATE WAGES, HOURS, AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT, WITH THE APPROPRIATE MANAGEMENT LEVEL, (3) REPRESENTATIVES OF RECOGNIZED EMPLOYEE ORGANIZATIONS MAY PARTICIPATE IN SUCH MEETINGS WITHOUT LOSS OF COMPENSATION OR OTHER BENEFITS, (4) EMPLOYEE ORGANIZATIONS ARE DEFINED AS REGISTERED OR RECOGNIZED, (5) EMPLOYEE REPRESENTATION UNITS ARE DETERMINED BY THE COUNTY PERSONNEL BOARD, AS ARE THE PROCEDURES BY WHICH DISPUTES WILL BE RESOLVED BETWEEN CONTESTING EMPLOYEE UNITS, (6) RECOGNIZED EMPLOYEE ORGANIZATIONS ARE CERTIFIED, THE PROCEDURE BY WHICH A CHALLENGE BY ANOTHER EMPLOYEE ORGANIZATION CAN BE HANDLED AND RESOLVED, AND (7) PROCEDURES ARE SET FORTH SO THAT IMPASSES CAN BE RESOLVED BY MEDIATION. IT IS FELT THAT THE ADOPTION OF THE COUNTY ORDINANCE MARKS THE BEGINNING OF A NEW ERA IN EMPLOYEE-MANAGEMENT RELATIONS WHICH CAN RESULT IN THE IMPROVEMENT IN COUNTY SERVICES RENDERED BY ALL COUNTY EMPLOYEES TO THE BETTERMENT OF THE PUBLIC'S INTEREST AND WELFARE.
