THE REGULATIONS REFERRING TO HIGHWAY CONSTRUCTION CONTAINED IN THE (GERMAN) FEDERAL POLLUTION PROTECTION LAW HAVE POSED A NUMBER OF PROBLEMS IN LEGAL PRACTICE AND JURISDICTION. THE HISTORY OF THE ORIGINS OF THE REGULATIONS IS OUTLINED. WHERE SPATIAL AND PHYSICAL PLANNING IS BEING UNDERTAKEN, IT IS NECESSARY TO REFLECT THAT DAMAGING ENVIRONMENTAL ACTIONS TO RESIDENTIAL AND OTHER PROTECTED AREAS MUST BE AVOIDED. BY THE CONSTRUCTION OR ESSENTIAL CHANGING OF PUBLIC HIGHWAYS IT IS NECESSARY TO ENSURE THAT NO ENVIRONMENTALLY DAMAGING ACTION IS BROUGHT ABOUT WHICH COULD BE AVOIDED USING CURRENTLY AVAILABLE TECHNIQUES. THE EFFECTS OF THESE REGULATIONS ARE SET OUT IN DETAIL. THE DEFINITIONS OF NOISE EMISSION THRESHOLD LEVELS REMAIN SUBJECT TO DECREE. A HIGHWAY NOISE LEVEL ORDINANCE IS BEING PREPARED IN THE FEDERAL MINISTRY OF TRANSPORT. CRITICISM IS MADE OF THE PROPOSED IDEAS AND REGULATIONS. THE PROBLEM OF COMPENSATION FOR TRAFFIC NOISE CONTROL MEASURES, THE RELATION OF THE FEDERAL POLLUTION LAWS TO HIGHWAY LEGAL REGULATIONS, PARTICULARLY TO THE TRUNK ROAD LAWS, AND THE TRANSITION REGULATIONS ARE DISCUSSED.
