THE POWER OF PENAL LAW TO REHABILITATE AND RE-EDUCATE PERSONS CONVICTED OF ALCOHOL RELATED TRAFFIC OFFENCES

A LARGE PERCENTAGE OF PERSONS CONVICTED FOR ALCOHOL RELATED TRAFFIC OFFENCES HAVE A CHRONIC ALCOHOL PROBLEM. STATISTICS ARE CALCULATED TO BE 19% FOR SWITZERLAND, 50% FOR SWEDEN AND AS HIGH AS 78% FOR THE USA. THERE ARE NO FIGURES AVAILABLE FOR GERMANY. IT IS ESTIMATED THAT ONE IN EVERY 700 PERSONS DRIVING WHILST UNDER THE INFLUENCE OF ALCOHOL RUNS THE RISK OF BEING APPREHENDED BY THE POLICE. IN ALL CASES INVOLVING DEFENDENTS WITH TWO OR MORE CONVICTIONS, THE CRIMINAL COURT OF THE COUNTY ASSIZES IN HILDESHEIM HAS, WITH THE AID OF EXPERT ADVICE, ASSESSED WHETHER THE OFFENDER IS A VICTIM OF ALCOHOL ADDICTION. AS A RESULT OF THIS, 4 OUT OF 20 OFFENDERS HAVE BEEN REFERRED FOR MEDICAL TREATMENT. IT WAS RECOMMENDED THAT 5 OF THE OFFENDERS SHOULD PARTICIPATE IN COURSES FOR BREAKING THE HABIT OF ALCOHOL CONSUMPTION. GROUP DISCUSSIONS WERE RECOMMENDED IN TWO INSTANCES. IN ONLY ONE OF THE 12 CASES DEALT WITH, WERE REHABILITATION MEASURES DEEMED UNNECESSARY. EVEN WHERE THE NUMBER OF CASES DEALT WITH IS TOO SMALL TO BE REPRESENTATIVE, IT IS RECOMMENDED THAT GREATER EMPHASIS SHOULD BE PLACED ON THE NEED FOR REHABILITATION WHEN ASSESSING ALCOHOL RELATED TRAFFIC OFFENCES.
