ROAD TRAFFIC LAW IN HUNGARY

THE PRECEPTS OF HUNGARIAN CRIMINAL LAW GOVERNING PUNISHABLE TRAFFIC OFFENCES HAVE BEEN NEWLY REGULATED BY AN AMENDMENT TO THE PENAL CODE WHICH CAME INTO EFFECT ON 1/1/72. DELIBERATE DANGEROUS DRIVING IS PUNISHABLE WITH IMPRISONMENT OF 1-5 YEARS, WITH IMPRISONMENT OF 2-8 YEARS IN THE CASE OF PHYSICAL INJURY LASTING LONGER THAN 8 DAYS AND IMPRISONMENT OF 5-8 YEARS IF THE OFFENCE LEADS TO LOSS OF LIFE. MANSLAUGHTER WHEN DRIVING IS PUNISHABLE BY IMPRISONMENT OF 1-5 YEARS AND UNDER CERTAIN CIRCUMSTANCES 2-8 YEARS, THE LATTER COMING INTO EFFECT IF THE OFFENDER IS UNDER THE INFLUENCE OF ALCOHOL AT THE TIME OR CAUSES SEVERAL FATALITIES. SIMILARLY HEAVY PENALTIES ARE IMPOSED FOR OTHER TRAFFIC OFFENCE TYPES. BLOOD ALCOHOL CONTENTS OF UP TO 0.8 ARE REGARDED AS A BREACH OF REGULATIONS AND ARE PUNISHABLE BY A FINE. IN THE CASE OF BLOOD ALCOHOL LEVELS OF OVER 0.8 IMPRISONMENT OF UP TO 1 YEAR MAY BE IMPOSED. LEAVING THE SCENE OF THE ACCIDENT IS ALSO PUNISHABLE WITH IMPRISONMENT OF UP TO 1 YEAR. IN THE CASE OF ALL PUNISHABLE TRAFFIC OFFENCES THE DRIVING LICENCE MAY BE CONFISCATED. THE REPORT CONTAINS A LIST OF THE MOST IMPORTANT PRECEPTS OF CRIMINAL LAW. THE "CONFIDENCE PRINCIPLE" AS APPLIED IN THE FEDERAL REPUBLIC OF GERMANY APPLIES HERE ALSO.
