THE CHILD IN TRAFFIC FROM THE POINT OF VIEW OF THE ADMINISTRATION OF JUSTICE

DAS KIND IM STRASSENVERKEHR AUS DER SICHT DER RECHTSPRECHUNG

THE DANGER TO CHILDREN IN ROAD TRAFFIC CAN BE DUE TO THE BAD TRAFFIC BEHAVIOUR OF OTHER ROAD USERS, TO THE BAD TRAFFIC BEHAVIOUR OF THE CHILDREN OR TO INADEQUATE SUPERVISION OF THE CHILD. THE ADMINISTRATION OF JUSTICE IS OF NECESSITY CASUISTIC. THE YOUNGER THE CHILD IS, THE GREATER THE REQUIREMENTS ON CARE ON THE PART OF THE DRIVER. FROM APPROXIMATELY THE AGE OF SEVEN ONWARDS, THE CHILD ASSUMES AN INCREASING PART OF THE BLAME. THE DRIVER WHO PASSES A STATIONARY SCHOOL BUS HAS A PARTICULAR RESPONSIBILITY. HE MUST EXPECT BAD TRAFFIC BEHAVIOUR FROM SMALL CHILDREN, AND ON OCCASION ALSO FROM OLDER CHILDREN AND ADJUST HIS DRIVING PATTERN ACCORDINGLY. THE MERE TEACHING AND TRAINING OF THE CHILDREN IN CORRECT TRAFFIC BEHAVIOUR IS NOT SUFFICIENT. THE SUPERVISING ADULTS MUST EXERCISE ADEQUATE CARE OF THE CHILDREN. IN THE SETTING UP AND SUPERVISION OF SCHOOL BUS STOPS, THE AUTHORITIES HAVE PARTICULAR OBLIGATIONS. NUMEROUS INDIVIDUAL CASES ARE EXAMINED.
