THE PENALTIES FOR OFFENCES INVOLVING DRUNKENNESS IN ROAD TRAFFIC

ZUM STRAFMASS BEI TRUNKENHEITSDELIKTEN IM STRASSENVERKEHR

DURING THE LAST TWO DECADES THE PENALTIES IMPOSED BY THE COURTS FOR OFFENCES INVOLVING DRUNKENNESS IN ROAD TRAFFIC HAVE BEEN EXTREMELY NON-UNIFORM. RECOMMENDATIONS BY THE GERMAN TRAFFIC COURT CONGRESS HAVE BEEN CRITICISED BY SOME AUTHORS, BUT HAVE LED TO EQUALISATION OF ASSESSING PENALTIES IN THE VARIOUS COURT DISTRICTS. THIS APPLIES MAINLY TO DRUNKEN DRIVING WITHOUT SERIOUS CONSEQUENCES, WHEREAS IN CASES INVOLVING CONCRETE DANGERS OR PERSONAL INJURY OR DEATH THE SEVERITY OF THE PENALTY DEPENDS TO A GREAT EXTENT ON THE FACTS OF THE PARTICULAR CASE. THE STANDARDISATION OF PENALTIES DETERMINED FOR THE GENERAL CASE, INCLUDING DRIVING BANS FOR SPECIFIC PERIODS, IS DESIGNED TO BE EDUCATIONAL AND THUS TO IMPROVE TRAFFIC SAFETY.
