COMPULSORY WEARING OF SEAT BELTS - NO FUNDAMENTAL LEGAL PROBLEM

THE AUTHOR OPPOSES THE VIEW THAT COMPULSORY WEARING OF SEAT BELTS IS IN CONTRADICTION TO THE FUNDAMENTAL LAW. HE CONSIDERS THE JUDGMENT OF THE FEDERAL COURT OF JUSTICE TO BE OUT-OF-DATE, IN WHICH THEY REVERSED A PREVIOUS DECISION THAT A DRIVER WAS PARTIALLY RESPONSIBLE FOR HIS OWN INJURY BY NOT USING A SAFETY BELT. MUCH MORE IS INVOLVED IN THE PROPER APPORTIONMENT OF DAMAGES FOR INSURANCE PURPOSES IN THE CASE OF NON-USE OF SEAT BELTS THAN THE EVALUATION OF PARTIAL BLAME.
