THE PERCENTAGE DISTRIBUTION OF TIME INTERVALS BETWEEN DRUNKENNESS OFFENCES IN TRAFFIC DUE TO BEING DRUNK WHILE DRIVING

DIE PROZENTUALE VERTEILUNG DER ZEITLICHEN ABSTAENDE ZWISCHEN DEN TRUNKENHEITSDELIKTEN IM STRASSENVERKEHR BEI ALKOHOLAUFFAELLIGEN KRAFTFAHRERN

BASED ON A SAMPLE OF THREE-TIMES-CONVICTED DRUNKENNESS OFFENDERS THE TIME INTERVALS BETWEEN OFFENCES WERE RETROSPECTIVELY CALCULATED. THE CHOICE OF SAMPLE AND POSSIBLY SIGNIFICANT EXTERNAL CIRCUMSTANCES ARE DISCUSSED. THE ARGUMENT IS PUT FORWARD THAT EMPIRICALLY DETERMINED DATA OF THIS KIND ON INTERVALS BETWEEN OFFENCES MIGHT FORM A BASIS FOR THE CALCULATION OF A STANDARD PERIOD OF RISK. THE DATA ON TIME INTERVALS BETWEEN OFFENCES INDICATE THAT MORE THAN 50 PER CENT OF RECIDIVIST DRUNKENNESS OFFENDERS DO NOT REPEAT THE OFFENCE WITHIN A PERIOD OF THREE YEARS. THE STANDARD PERIOD OF RISK SHOULD BE TAKEN AS NOT LESS THAN TEN YEARS.
