LIABILITY IN ACCIDENTS AFTER DARK

THE JUDGING OF ACCIDENT CASES WHICH OCCUR AFTER DARK IS A FORENSIC ASPECT OF TRAFFIC WHICH POSES MANY PROBLEMS. THE MOST IMPORTANT CRITERIA ARE THE OBJECTIVE RECOGNITION OF OBSTACLES, THE LIGHTING CONDITIONS AT THE ACCIDENT SPOT, POSSIBLE DAZZLE FROM ONCOMING VEHICLES AND OTHER DISTURBING FACTORS WHICH INCREASE THE REACTION TIME, THE SUBJECTIVE VISIBILITY OF THE DRIVER AND THE RECOGNITION OF VISUAL ERRORS BY THE DRIVER. THUS DIFFICULTIES ARISE IN MARSHALLING THE EVIDENCE. AN INTER-DISCIPLINARY COOPERATION IS NECESSARY FOR CLARIFICATION. A STUDY OF TWILIGHT LEVELS AND OF THE IMPROVEMENT OF PERCEPTIBILITY OF TRUCKS IN DARKNESS IS PRESENTED. CURRENT ADMINISTRATION OF JUSTICE IS DISCUSSED, PARTICULARLY THE QUESTION OF DETERMINING LIABILITY. IN THE MARSHALLING OF EVIDENCE, A THOROUGH CHECK ON THE CONDITIONS AT THE SITE OF THE ACCIDENT BY THE POLICE IS REQUIRED.
