FEDERAL GERMAN ROAD TRAFFIC REGULATIONS DO NOT ACKNOWLEDGE THE TERM HARD SHOULDER ALTHOUGH IT HAS BECOME ACKNOWLEDGED AS A LEGAL TERM. HARD SHOULDERS ARE NOT INTENDED FOR USE BY FLOWING TRAFFIC BUT FOR DRIVING ONTO OR STOPPING ON IN EMERGENCIES. WHILST A CRAWLER LANE FORMS PART OF THE MAIN CARRIAGEWAY, ACCELERATION AND DECELERATION LANES ARE INDEPENDENT CARRIAGEWAYS ACCORDING TO THE LAW AND NOT PART OF THE THROUGH TRAFFIC STREAM. HARD SHOULDERS HOWEVER DO NOT FALL INTO ANY CLEAR LEGAL CATEGORY. THE LAW CONSIDERS OVERTAKING ON THE HARD SHOULDER AS OVERTAKING ON THE RIGHT WHICH IS NOT PERMITTED. CONTRARY TO THIS THE AUTHOR CONSIDERS THE HARD SHOULDER TO BE A SPECIAL CARRIAGEWAY SO THAT OVERTAKING ON THE RIGHT IS NOT CONTRARY TO THE OVERTAKING RULES, BUT INSTEAD UNJUSTIFIED USE OF THE HARD SHOULDER WHICH CONTRAVENES THE RULES OF CARRIAGEWAY USAGE. A DRIVER WHO OVERTAKES REGARDLESSLY ON THE RIGHT USING THE HARD SHOULDER AND SUBSEQUENTLY CUTS IN TO THE LEFT WOULD BE OVERTAKING INCORRECTLY, BECAUSE THE UNDERSTANDING OF OVERTAKING IN CASES OF CAUSING DANGER TO OTHER ROAD USERS IS STILL NOT CLEAR.
