THIS PAPER DEALS WITH THE DIFFERENCE BETWEEN DRUNKENNESS AND INABILITY TO DRIVE DUE TO ALCOHOLIC EFFECTS. ALSO THE DEVELOPMENT OF LEGISLATION FOR PUNISHMENT FOR DRIVING UNDER ALCOHOLIC INFLUENCE IS DEALT WITH IN ADDITION TO THE PRESENT REGULATIONS IN PENAL LAW AND THE LAWS ON INFRACTION OF REGULATIONS. THE SPECIAL FEATURES RELATED TO THE QUICK DRINK AND FINAL DRINK AND THE RECONSTRUCTION ARE DISCUSSED. THE APPLICATION OF THE LEGAL REQUIREMENT AND THE DIFFERENCES BETWEEN PROOF LIMITING VALUES AND DANGER LIMITING VALUES ARE SHOWN. INTERNAL SPECIAL RULES ARE IMPOSED FOR PUBLIC TRANSPORT BUSINESSES SUCH AS LUFTHANSA, GERMAN STATE RAILWAYS AND THE FEDERAL GERMAN POST. THE ACCIDENT PREVENTION RULES "GENERAL RULES" (VGB 1) CONTAIN ONLY AN UNCLEAR, INADEQUATE RULING. FIRMS' AGREEMENTS CAN REACH A SUITABLE SOLUTION. FINALLY THE COMBINED EFFECTS OF ALCOHOL AND DRUGS AND ALCOHOL AND INDUSTRIAL POISONS ARE DISCUSSED.
