USE OF HERBICIDES BY UTILITIES ON HIGHWAY RIGHTS-OF-WAY

THE SUBJECT OF ALLOWING UTILITIES TO USE HERBICIDES ON HIGHWAY RIGHTS-OF-WAY OPENS AN ENTIRELY NEW TYPE OF PROCEDURE AND IS FAR-REACHING IN MANY RESPECTS. IT IS NOT COMPARABLE TO OTHER TYPES OF WORK, SUCH AS TREE TRIMMING FOR LINE CLEARANCE. NOR CAN THE USES AND PROCEDURES BE COMPARED TO SO-CALLED CROP SPRAYING DONE BY FARM OWNERS OR CONTRACTORS WHO DO CROP SPRAYING. WHEN HERBICIDES ARE ALLOWED TO BE USED ON HIGHWAY RIGHTS-OF-WAY BY UTILITIES, IT SHOULD BE CONSIDERED AS AN ASSISTANCE TO UTILITIES TO MAINTAIN THEIR LINES BY A NEW METHOD OF PROCEDURE, BUT AT THE SAME TIME TO THE EXTENT ONLY THAT HIGHWAY INTERESTS WILL BE PRESERVED. THUS, TO ACCOMPLISH THE PURPOSES REQUIRES THE COOPERATION AND COORDINATION OF BOTH THE UTILITIES AND THE HIGHWAY DEPARTMENT. WHEN PERMITTED, IT BECOMES, IN A WAY, A PART OF THE HIGHWAY MAINTENANCE PROGRAM. THUS IT IS NECESSARY AND ESSENTIAL THAT THE HIGHWAY DEPARTMENT PROMOTE THE CONDITIONS UNDER WHICH IT MAY BE DONE. /AUTHOR/
