The recommendation is made that in any situation where it is possible for an insured to stow his own cargo the concept of carrier negligence should be abandoned. The bill of lading, or waybill, would state that by paying 2 1/2% of the freight to the primary cargo underwriter, the carrier is not responsible for proven negligence, nor any loss or damage to the container while in his care, custody or control.
