BENEFITS OF REDEFINING THE TERM "COMPLETION DATE"

With the increased use of incentive and disincentive clauses, careful attention must be given to the definitions of the "completion date" and whether the stated completion date should be extended as a result of unexpected delays. If a contractor is able to establish that an unforeseen event delayed a "controlling item" of a project, an extension of the incentive/disincentive completion date is warranted. When the extension is actually granted during the job, costly and time-consuming litigation can often be avoided.
