There is presently considerable interest in reducing the costs associated with disputes and litigation in the facility acquisition process. One of the best ways to reduce such costs is to solve problems before they become disputes. More effort in creating a good understanding of the agreement, rather than the form of the agreement is proposed here as one way to prevent problems becoming disputes.
