WITH STATE BELT-USE LAWS - EXEMPTIONS ARE THE RULE
A national survey was conducted to identify exemptions to belt-use laws of various states and to explore their bases, consistency, and possible implications. Provisions of the various state belt-use laws were reviewed, state police departments were contacted to determine their interpretation of these exemptions, and corporate and union officials were interviewed to determine how the laws affect fleet operations. The exemptions were categorized as follows: (1) exemptions based on vehicle type; (2) exemptions based on vehicle usage; and (3) exemptions for certain operators or passengers. Several states exempt passengers if they are over a certain age. Medical exemptions for safety considerations are also discussed. Exemptions for emergency vehicle operators, state police personnel, and exemptions for seating location are also considered. The article emphasizes that only a safety value system responsive to these special needs should be considered in mandating restraint use.
