Criminological, penologic and crimino-political aspects of alcohol interlocks in Germany

Alkohol-Interlocks sind ein praeventiver Beitrag zur Verkehrssicherheit im Bereich der Alkoholfahrten. Ihr obligatorischer Einbau in alle Kraftfahrzeuge kommt aus verfassungsrechtlichen Gruenden nicht in Betracht. Neben dem freiwilligen Einbau - zum Beispiel bei Gefahrguttransporten - waere ihr Einbau in folgenden rechtlichen Konstellationen moeglich: im Strafrecht als Bewaehrungsweisung, bei beschraenkter Entziehung der Fahrerlaubnis und - in Kombination mit Nachschulungskursen - zur Verkuerzung der Sperrfrist fuer die Wiedererteilung der Fahrerlaubnis, im Fahrerlaubnisrecht als bedingte Fahrerlaubnis unter Auflagen oder Beschraenkungen. (A) ABSTRACT IN ENGLISH: Alcohol interlocks are a preventive contribution to the area of drunk driving in traffic safety. A mandatory installation in all vehicles in from the perspective of constitutional rights disproportionate. In addition to a voluntary use - e.g. in the transport of dangerous goods - the use in the following combination would be possible: in criminal law as an order of probation, in cases of conditional withdrawal - in combination with a rehabilitation measure - for a reduction of the revocation period, in driving licensing law as conditional license with obligations and restrictions.
