ACQUISITION OF SCENIC EASEMENTS
THE GOVERNMENTAL FRAMEWORK ESTABLISHED IN CALIFORNIA TO CONDUCT PLANNING AND CORRIDOR DEVELOPMENT THROUGH SCENIC EASEMENT ACQUISITION IS DESCRIBED. THE STRUCTURE FOR COORDINATION BETWEEN PUBLIC AGENCIES AND THE STATE AND ITS POLITICAL SUBDIVISIONS IS DESCRIBED. A ROLE IS OUTLINED FOR THE PARTICIPATION OF NONGOVERNMENTAL GROUPS IN THE CORRIDOR PLANNING PROCESS. THE CHOICE BETWEEN THE USE OF NEGOTIATED PURCHASE OR EMINENT DOMAIN AS THE MEANS OF CARRYING OUT A SCENIC EASEMENT ACQUISITION PROGRAM IS DISCUSSED. IT IS CONCLUDED THAT THE NEGOTIATED PURCHASE SEEMS PREFERABLE SINCE THEY PERMIT MORE FLEXIBLE TREATMENT OF THE LANDOWNERS PERSONAL PROBLEMS WITHIN THE FRAMEWORK OF OBJECTIVES.
