THE EVOLUTION OF PENAL LAW IN THE MATTER OF ROAD TRAFFIC AND THE PROBLEMS OF THE PRESENT DAY

Driving offences have their place in the law concerning road traffic and constitute a new chapter of special penal law. Criminalists have given very little attention to this new branch of penal law, which raises specific problems. There is a tendency to maintain a uniform set of regulations. With respect to the distinction between criminality and road delinquency, the author considers that dangerous driving and driving under the influence of alcohol must be given their place in the penal code, while all other shortcomings could be "decriminalized", instituting a disciplinary, administrative law, independent of traditional penal law. The European committee on criminal problems, however, prefers a "step-by-step" policy. /TRRL/
