Road Transport Working Time Directive, Self-employed and Night Time Provisions
A directive (Directive 2002/15/EC) was adopted by the European community in March 2002 that concerns hours of labor for people whose work involves mobile highway transportation of some sort. These workers would include drivers, conductors, tour guides, and apprentices and trainees. The directive established a maximum weekly average work time of 48 hours over a 4 month period. It also sets a limit of 10 hours of night work in any 24 hour time frame. The aim of the directive is to improve highway safety and improve the health of the workers. It is important to note that self employed workers are excluded from the directive. This paper discusses the directive, its impact on highway safety and worker health, and whether or not the exclusion of self employed individuals is a good idea.
