INTERNATIONAL CONVENTIONS AND IMPLEMENTING LEGISLATION ON LIABILITY AND COMPENSATION FOR OIL POLLUTION

The report describes the international conventions and implementing legislation on liability and compensation for oil pollution damage. The actions proposed are the ratification of the International Convention on Civil Liability for Oil Pollution Damage and the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, and the enactment of the Act to implement these Conventions. Together, the Act and Conventions provide for strict liability, within certain monetary limits, on the part of the owner of vessels carrying oil for oil pollution damage, and create a fund from mandatory contributions of receivers of oil carried by sea to further compensate victims of oil pollution damage. All coastal states are particularly affected by the proposed actions. The Act and conventions will improve the quality of the marine and coastal environments by encouraging more adequate precautions by vessel owners to minimize vessel spills, and more efficient and expeditious measures to contain and clean up any oil discharged by vessels. No harmful effects on the environment are expected. (Author)
